Even as the real estate market on Gasparilla Island and elsewhere in Florida returns to normalcy, a House Justice Appropriations Subcommittee vote reminded the Great Recession still remains a weight on the state economy.

State Rep. Kathleen Passidomo's, R-Naples, controversial House Bill 87 would expedite foreclosures.

Florida's judicial foreclosure system requires mortgage lenders to file a civil lawsuit to foreclose on a home in default. With the unprecedented number of Florida mortgage defaults - twice the national average - Florida foreclosure lawsuits have increased to unprecedented numbers.

Passidomo said Florida's judicial system has become bottlenecked as a result and her bill is an attempt to fix the problem. HB 87 would allow some foreclosure lawsuits to be re-routed into an expedited foreclosure process.

Pushing foreclosures along faster is controversial. Does it favor banks at the expense of beleaguered homeowners?

There was opposition to the bill at the committee meeting where it passed, said Booker Perry for PICO United Florida. Other opponents included Dale Landry, president of the Tallahassee Branch of NAACP; and Alice Vickers of Florida Consumer Action Network and Florida Legal Services.

Danielle Kelley, an attorney who defends foreclosures and is herself in foreclosure, said she was told by her lender to stop payments to qualify for a trial loan modification only to have a foreclosure filed against her when the lender refused to make the loan modification permanent.

State Rep. Kerner, D-West Palm Beach, voted against the bill claiming it would have a disproportionate impact of foreclosures on Hispanic populations. The bill still needs approval of the Florida Legislature.
